Terms and Conditions

1. Scope
The following Terms and Conditions (T&Cs) apply to all orders placed by consumers and businesses through our online store.

For Germany: According to § 13 of the German Civil Code (BGB), a consumer is any natural person who concludes a legal transaction for purposes that are predominantly not attributable to their commercial or independent professional activity.

For Austria: In the following conditions, "consumer" is understood as defined in the Consumer Protection Act (KSchG).

For Switzerland: In the following conditions, "consumer" is defined according to Swiss law.

For businesses: If a business uses conflicting or additional terms and conditions, their validity is hereby objected to; they will only become part of the contract if we expressly agree to them.

2. Contracting Party, Contract Conclusion, Correction Options
The purchase contract is concluded with Riderstyle Trading GmbH.

By presenting the products in the online store, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your final order by using the correction tools provided and explained in the ordering process. The contract is concluded when you accept the offer by clicking the order button for the items in the shopping cart. Immediately after submitting your order, you will receive a confirmation by email.

3. Contract Language, Contract Text Storage
The language(s) available for concluding the contract: German, English, French.

We save the contract text and send you the order details and our T&Cs in text form. You can view the contract text in your customer login.

4. Subject Matter of the Contract
4.1 Product Description
The validity of each product description as an essential part of the contract is noted.

4.2 Product Images
Notwithstanding your statutory warranty rights, please note the following specifics: Due to individual screen configurations (e.g., resolution and brightness), slight color variations between displayed and actual product colors may occur.

5. Delivery Conditions
5.1 Delivery Area
We deliver within Germany, Austria, and Switzerland.

5.2 Shipping Costs
In addition to the stated product prices, shipping costs will be added for standard shipping.

5.3 Delivery Options
Products are shipped to the delivery address specified in the ordering process. We deliver only via shipping and unfortunately cannot offer in-store pickup.

6. Payment
6.1 Prices
The prices valid at the time of the order apply. These are total prices and include the applicable VAT.

6.2 Due Date and Payment Default
The price is due upon contract conclusion unless a later date is specified in the payment terms below.

For customers in Germany and Austria:
For consumers: In the event of payment default, we reserve the right to charge a fee of 1.50 EUR per reminder from the second reminder onwards. You are entitled to prove that a lesser damage has occurred.

For businesses: In the event of payment default, we charge statutory default interest of nine percentage points above the base rate, plus a flat fee of 40 EUR. Other claims remain unaffected.

For customers in Switzerland:
For consumers: In case of payment default, we reserve the right to charge a fee of 1.50 CHF per reminder from the second reminder onwards. You are entitled to prove that a lesser damage has occurred.

For businesses: In the event of payment default, we charge default interest of nine percentage points above the ECB base rate, plus a flat fee of 40 CHF. Other claims remain unaffected.

6.3 Payment Methods
The following payment methods are available in our shop:

  • Bank Transfer: When selecting bank transfer, we will provide you with our bank details in a separate email, and the goods will be delivered upon receipt of payment.
  • Credit Card: Your credit card details are provided during the ordering process, and your card is charged immediately after placing the order.
  • PayPal, PayPal Express: To pay via PayPal, you must be registered with PayPal, verify your identity, and confirm the payment. The transaction is completed immediately after placing the order.
  • Google Pay: Requires prior registration with Google.
  • Apple Pay: Requires the activation of Apple Pay and the use of the Safari browser.

7. Right of Withdrawal
Consumers have the statutory right of withdrawal as described in the withdrawal instructions. Businesses are not granted a voluntary right of withdrawal.

8. Retention of Title
The product remains our property until full payment is made.

For Switzerland: We reserve the right to make an entry in the retention of title register.

For businesses: The retention of title extends to all claims arising from a business relationship.

9. Transport Damage
For consumers: Please report any obvious transport damage to the delivery carrier as soon as possible and contact us immediately.

For businesses: The risk of accidental loss and deterioration passes to you as soon as we deliver the item to the carrier.

10. Data Backup
You are responsible for proper and regular data backup. We are not liable for data loss if such a loss could have been prevented by regular, comprehensive data backups.

11. Warranty and Complaints
11.1 Defects Warranty
For consumers in Germany and Austria: The statutory warranty applies.

For consumers in Switzerland: Consumers should inspect the goods as soon as reasonably possible. If defects are found, they must be reported immediately to the seller. Failure to do so constitutes acceptance of the goods.

11.2 Guarantees and Customer Service
Details on any applicable additional guarantees and their conditions are available with the product and on specific information pages in the online store.

12. Liability
For claims arising from damages caused by us or our representatives, we are fully liable for:

  • Injury to life, body, or health,
  • Intentional or grossly negligent breaches of duty,
  • Promises of guarantees, if agreed upon,
  • Cases covered by the Product Liability Act.

For breaches of essential contractual obligations (cardinal obligations), our liability is limited to foreseeable damages typical for this type of contract.

13. Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR), which can be found here. We are willing to participate in an out-of-court dispute resolution process.

14. Final Provisions
For businesses, German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a merchant within the meaning of the German Commercial Code, a legal entity under public law, or a special fund under public law, the exclusive jurisdiction for all disputes arising from contractual relationships between us and you is our business location.

Should individual clauses of these T&Cs be wholly or partially invalid, the contract remains effective. The content of the contract shall then be governed by statutory provisions.
